Holiday Accommodation Rental - Terms and Conditions
These Holiday Accommodation Rental Terms and Conditions contain important information. It is essential that you carefully read and understand them.
Our website www.siestaadvisor.com (hereinafter referred to as “The Site”) provides a place where Property Rental Agents or Private Property Owners (hereinafter referred to as “The Owner”) can advertise holiday homes (hereinafter referred to as "The Property") for rental, to potential tenants.
References to "you" or "your" are references to the person looking for holiday accommodation and all members of your holiday party (hereinafter referred to as “The Holidaymaker”).
By accessing The Site, you, The Holidaymaker can view advertising of, and obtain information about, The Properties offered for rental by The Owners, and communicate with the Owners.
Bookings made are subject to The Owners` Terms and Conditions and Policies and The Holidaymakers should read those before proceeding with their booking.
2. SIESTA ADVISOR` STATUS
Siesta Advisor Javea acts as independent mediator in between The Owner of the Property and The Holidaymaker. Accordingly, any contract made is between you The Holidaymaker who is making the booking and The Owner.
Siesta Advisor Javea is not, and does not become, party to any contractual relationship between The Holidaymaker and The Owner, and does not mediate between The Holidaymaker and The Owner in the event of any dispute arising between them. Our role is limited to only facilitating bookings and transferring requests received from The Holidaymakers. We do not arrange documentation, nor we ask for payments or send any refunds.
Siesta Advisor Javea accept no liability in relation to any contract you enter into with The Owner or for any services or arrangements you purchase from them or for the acts or omissions of any Owner or other person or party connected with any arrangements relating to your Property rental.
3. COMMUNICATION WITH THE OWNER
If The Holidaymaker finds a Property in which they are interested, they can contact The Owner directly where contact information provided. The Holidaymaker can also submit a general request (hereinafter referred to as "The Enquiry") via The Site, stating the details of the property, the dates, their names, postal and e-mail address, phone number, and other requested information. In this case The Enquiry form will be forwarded to the email provided by The Owner of the relevant Property. The Holidaymaker can also use Contact Us menu point with any questions relating to their planned vacation and holiday accommodation.
The Holidaymaker receives confirmation from Siesta Advisor Javea, once The Enquiry has been sent to The Owner. The Owner may then communicate with The Holidaymaker in connection with the Enquiry. They will send a Booking Form and Terms and Conditions for the property, together with all necessary information The Holidaymaker might need in order to carry on with and complete the booking.
Please check your confirmation carefully and report any incorrect or incomplete information to The Owner immediately. Please ensure that names are correct. As we act only as mediators, we have no responsibility for any errors in any documentation except where an error is made by us.
Siesta Advisor Javea has no responsibility for the communication between the Owner and the Holidaymaker.
4. YOUR PAYMENT FOR THE PROPERTY
The Holidaymaker will pay agreed and confirmed rental fee directly to The Owner. This will always be a deferred payment. Payment is deferred until The Owner has accepted or declined the booking, which is guaranteed to happen within 48 hours, but should be much quicker. This is only used where The Owner receives bookings from numerous sources and needs to confirm availability exists in order to avoid double bookings.
The balance of The Property rental usually becomes payable eight weeks prior to arrival (unless otherwise stated or agreed). At this time, The Owner shall liaise with The Holidaymaker regarding their travel arrangements, proposed time of arrival and when and where to pick up the keys.
5. RENTAL PRICES
Changes and errors sometimes occur, and we, on behalf of the Owner, reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in confirmed prices where necessary. Prices shown on The Site may have changed by the time you come to book your arrangements.
Although we make every effort to ensure the accuracy of The Site information and prices at the time of printing, regrettably errors do occasionally occur. You must therefore ensure you check the price and all other details of your chosen Property at the time of booking.
6. NUMBER IN PARTY
Under no circumstances may the number of The Holidaymakers occupying The Property exceed the number stipulated in The Property description unless agreed in advanced and in writing by The Owner.
If the composition of the party changes after the booking has been made, the Owner must be advised and agree to the change.
You agree not to act in any way which would cause disturbance to those residents in the neighbouring properties.
The Owner reserves the right to take any appropriate action, including immediate termination of the tenancy (when no refunds will be made and the Owner will have no further liability to you) if the property including the pool and its grounds are abused or misused.
8. CARE OF THE PROPERTY
You shall take all reasonable and proper care of The Property and its furniture, pictures, fittings and effects in or on The Property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.
9. ARRIVAL & DEPARTURE TIMES
The majority of lettings commence at 4pm on the first day of your holiday and end at 10am on the day of departure. However some Properties differ from this and you will be notified of the times when your booking is confirmed by The Owner.
Any cancellation or amendment request must be communicated to The Owner in writing (email). If you write to us we will try to assist and liaise with The Owner on your behalf however we cannot guarantee that your requests will be met. We will confirm that we have received your notification and we will pass on your request to The Owner, who will then confirm whether or not it is possible to meet your request.
The Property policy on cancellation will be displayed in the relevant section of The Property rental Terms and Conditions. Some of The Properties may accept a cancellation (with or without a cancellation charge) but it is entirely at their discretion. Please ensure that you have received written confirmation of any changes to your booking prior to travel.
11. BREAKAGES OR DEMAGE
You are required to inform The Owner of any damage or breakage in or around The Property promptly so that it can be repaired and replaced for the next Holidaymaker. You are bound to reimburse The Owner for replacement, repair or extra cleaning costs where reasonably demanded.
12. RULES AND PROCEDURES
You are required to observe the rules and familiarise yourselves with the procedures contained in the information folder provided in each Property.
13. PROPERTY LISTING
The Owners are entirely responsible for the information, including images, text and other content, relating to the Properties they offer. Siesta Advisor Javea shall use commercially reasonable efforts to ensure that representation of the photos of the Properties that The Owners have submitted are as true and accurate as practicable.
To place a holiday property listing, The Owner request an application form by simple filling out our Contact Us form. No charge applicable; advertising The Property with us is free and always will be.
In the event of any problem arising on arrival or during the holiday, The Holidaymaker should immediately bring this to the attention of The Owner or their representative. Because the contract for your arrangements is between you and The Owner, any queries or concerns should be addressed to them.
If you fail to follow this procedure there will be less opportunity for The Owner to investigate and rectify your complaint. If you wish to complain when you return home, please write directly to the Owner concerned. You will see their name and contact details in any confirmation documents they send you.
We recommend that Holidaymakers obtain travel insurance against cancellation or amendment fees, as well as providing sufficient medical cover. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday.
16. RIGHT OF ENTRY
Whilst respecting the reasonable privacy of The Holidaymaker, The Owner reserves the right to access The Property at all times, if necessary, for repairs and emergencies.
Neither we nor The Owner shall be liable to you or any member of your party for any loss or damage to person or property arising from the letting.
You or members of your party cannot hold us or The Owners liable for any personal injury howsoever sustained where we and/or The Owners have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member of your party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.
18. PERSONAL INFORMATION
We collect your personal information to enable us to facilitate making your booking. We may also use your personal information (including e-mail address) to provide you with information about other travel related products or services available from Siesta Advisor Javea.
19. INTELLECTUAL PROPERTY
All content that appears on this site, and the site itself, is protected by copyright and database rights. Reproduction of the site, in whole or in part, including the copying of text, graphics or designs, is prohibited.
Holidaymakers are permitted to download, display or print individual pages of the site to evidence their agreement with Siesta Advisor Javea.
20. YOUR AGREEMENT
By using The Site for your booking with us you agree that you have read the Terms and Conditions set out in this document and you have read the Terms and Conditions set out by The Owner and agree to be bound by these Terms and Conditions.
